Choice of Forum
Where the contract is a 'commercial dispute' under the Commercial Courts Act, 2015 (specified value ₹3 lakh and above), the matter goes to the Commercial Court or Commercial Division. Where an arbitration clause exists, the dispute must first be referred to arbitration — we file Section 11 applications where the respondent resists.
Pre-Institution Mediation
Section 12A of the Commercial Courts Act requires pre-institution mediation unless urgent interim relief is sought. We handle the mediation reference and move to filing without unnecessary delay.
