Saket District Court

Advocate in Saket Court, Delhi

Civil, criminal and commercial matters filed and argued before the Saket Court complex, serving South and South-East Delhi.

Saket serves South and South-East Delhi — the districts where a large share of the city’s commercial leasing, high-value property and corporate employment disputes arise. The complex reflects that: a heavy commercial and civil list alongside the regular criminal roster. We appear here across all three, and the work begins with establishing that Saket is in fact the right forum.

Which Matters Are Heard at Saket

Saket exercises jurisdiction over the South and South-East districts of Delhi. The complex houses the District and Sessions Judge, Additional Sessions Judges, Civil Judges, Metropolitan Magistrates, Commercial Courts, Rent Controllers, Family Courts and designated Special Courts. Civil suits, recovery and commercial matters under the Commercial Courts Act, Section 138 cheque bounce complaints, criminal trials, bail applications, tenancy disputes and matrimonial proceedings are all heard here where jurisdiction lies.

Commercial Disputes and the Section 12A Question

Because South Delhi carries a dense concentration of businesses, a significant part of the Saket list is commercial. Where a dispute is a “commercial dispute” of the specified value under the Commercial Courts Act, 2015, it goes before the Commercial Court rather than the ordinary civil side, and Section 12A requires pre-institution mediation unless urgent interim relief is genuinely sought. Getting that assessment wrong at the outset is the most common reason a commercial plaint is returned. We settle the characterisation, the value and the mediation position before drafting.

Filing, Listing and Interim Relief

Filing runs through the e-filing system and the physical counters, with the registry raising objections on court fee, format, affidavits and annexures. Objections are the usual cause of avoidable delay. Where the matter needs protection on day one — an injunction against alienation, status quo on a property, or an order restraining encashment — the interim application must be drafted to stand on its own, because the first hearing is often where the matter is effectively won or lost.

Trial, Evidence and Execution

Evidence on the civil side is led by affidavit with cross-examination before the court or a Local Commissioner, and the cross-examination usually decides the suit. On the criminal side the matter moves through charge, prosecution evidence, the statement of the accused and defence evidence, with bail and interim applications running alongside. A decree is not the end: execution before the same complex is a separate proceeding, and we carry matters through to actual recovery or possession.
